OFFICIAL RULES

 

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER FOR A CHANCE TO WIN.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  THE SWEEPSTAKES IS OPEN ONLY TO PERSONS WHO ARE, AT THE TIME OF ENTRY, LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA AND AT LEAST 21 YEARS OF AGE OR OLDER. 

 

1. ELIGIBILITY:

 

The “Michelob ULTRA Pure Gold Tentrr Pass Sweepstakes” (“Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry.  The Sweepstakes is void outside of such geographic area, and where prohibited by law. Directors, officers, employees, agents, contractors and representatives of Sponsor, the Sweepstakes Administrator, and their affiliates and subsidiaries, as well as their advertising and promotion agencies, and service agencies, and wholesale alcohol distributors and retail licensees, and Tentrr, Inc., and members of their immediate family (spouse, parent, child or sibling) are not eligible to enter or win.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and the decisions of Sponsor and Sweepstakes Administrator, which are final and binding in all matters related to this Sweepstakes. Winning a prize is contingent upon fulfilling all requirements as set forth herein. 

 

2. SWEEPSTAKES PERIOD:

 

The Sweepstakes begins at 12:01:00 a.m. Eastern Standard Time (“EST”) on January 9, 2023, and ends at 11:59:59 p.m. Eastern Daylight Time (“EDT”) on April 15, 2023 (“Sweepstakes Period”).  Sponsor’s computer (or Sweepstakes Administrator’s if applicable) is the official time keeping device for this Sweepstakes. 

 

3. HOW TO ENTER:

 

During the Sweepstakes Period:

 

(a) Internet: Visit www.MichUltraPureGoldTentrrPass23.com (“Website”) and follow the online instructions to complete and submit an online entry. 

 

(b) QR Code entry:  Use the QR code read application already installed on your smart phone or other web-enabled device with data plan to scan the Sweepstakes quick response (“QR”) code featured on signs and/or promotional materials referring to the Sweepstakes at participating stores. You will then be directed to a mobile Web page where you may complete and submit an entry.  Proof of scanning QR codes does not constitute proof of completion or submission of an entry.

 

For all QR code entrants, to scan a QR code, entrants must have a smart phone or other web-enabled device with a camera feature and/or QR scanner application and may incur message or data charges from their wireless service provider for each message sent and received.  If you do not have a QR reader already installed on your phone, type ‘QR reader’ in your mobile device’s application store search field to find available QR readers for your smart phone or other web-enabled device. 

 

If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. 

 

There is a limit of one entry per person. Automated entries are prohibited, and any use of automated devices will result in disqualification. No person is allowed to enter with multiple email addresses nor use any other device or artifice to enter multiple times or as multiple entrants.  Any person who attempts to enter with multiple email addresses, under multiple identities, or uses any device or artifice to register multiple times will be disqualified, in Sponsor’s sole discretion.  Entrants are not permitted to share the same email address as another entrant. 

 

All entries must be received and recorded during the Sweepstakes Period. Only the methods of entry described herein are valid. No other forms of entry are valid.  To be valid, each entry must comply with all of these Official Rules. Any reference herein to an “entry” refers to valid entries submitted in accordance with these Official Rules by an eligible entrant.

 

4. SWEEPSTAKES DRAWING:

 

Upon the conclusion of the Sweepstakes Period, one (1) potential winner will be selected in a random drawing to be held on or about April 16, 2023 from amongst all eligible entries received by Sponsor during the Sweepstakes Period. Sponsor’s decisions are final in all matters relating to the selection of winner(s) and the Sweepstakes drawing. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period. 

 

5. WINNER NOTIFICATION:

 

All prizes will be awarded.  Potential winner(s) will be notified via email or phone call (or if entry is allowed in these Official Rules via a social media platform, then via direct message on the social media platform the potential winner used to enter the Sweepstakes), and will be required to respond to the notification indicating whether he/she/they will accept the prize within the time indicated by the Sponsor or Sweepstakes Administrator in the notification. If a potential winner does not respond to the notification within such time period, then such potential winner may be disqualified and an alternate potential winner will be randomly selected. Any alternate potential winner selected will also be required to respond to the notification within the time frame stated above.

 

Potential winner(s) may also be required to complete, sign and return an affidavit of eligibility and liability and, unless prohibited by law, publicity release to Sponsor or the Sweepstakes Administrator within the time indicated by Sponsor or Sweepstakes Administrator in the notification to the potential winner that such document(s) is/are required. Potential winners (and any travel companion where travel is awarded as a prize) may also be required to complete, sign and return a “Release of Liability, Voluntary Assumption of Risk and Indemnity Agreement” to Sponsor or Sweepstakes Administrator within the time indicated by Sponsor or Sweepstakes Administrator in the notification to the potential winner that such document(s) is/are required. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the potential winner is twenty-one (21) years of age or older, the potential winner will be declared an official winner of the Sweepstakes. If Sponsor cannot verify that the potential winner is twenty-one (21) years of age or older by the time specified by Sponsor, then the potential winner will be disqualified and an alternate potential winner will be randomly selected. 

 

In the event of a potential winner’s failure to comply with any of the time deadlines herein for the signature and/or return of any required document(s), then the potential prize winner will be disqualified, and an alternate potential winner will be randomly selected.  Any alternate potential winner selected will also be required to adhere to the time periods described herein. Any prize notification or prize returned to the Sponsor or its agencies as undeliverable will result in disqualification and that prize will be randomly awarded to an alternate potential winner. 

 

Sponsor is not responsible for suspended or discontinued Internet, wireless, or land-line phone service, or a change in an entrant’s email address, phone number or mailing address (or if entry is allowed in these Official Rules via a social media platform, a change in the entrant’s social media account settings) which may result in a potential winner not receiving initial prize notification or his/her/their prize information. 

 

6. PRIZE DETAILS:

 

            One (1) prize will be awarded. The prize consists of one (1) Tentrr Flex Pass. Approximate Retail Value (“ARV”) of the prize is $810. Use of the Flex Pass prize is subject to the Tentrr Pass Terms and Conditions.   

 

Limit of one (1) prize per person. Total ARV of all prizes is $810.  The actual value of each prize may vary.  Any difference between the actual value and ARV will not be awarded. Unless otherwise provided herein, no transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Unless otherwise provided herein, in the event a potential winner fails to accept all elements of a prize within the time designated by Sponsor, then the potential winner will be disqualified, and the prize will be awarded to an alternate potential winner via a random drawing.  If autographed prizes are awarded, any autographs are subject to the availability of the celebrity.  If a pre-paid gift card or e-check is awarded, then its use is subject to the terms and conditions imposed by the card issuer or e-check issuer. Allow 4-6 weeks for delivery of prizes. ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE RELEASED PARTIES (AS DEFINED BELOW) HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

 

Background Check: If Sponsor so elects, potential winner may be required to submit to a confidential background check.  Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the potential winner will not bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor.  If requested, the potential winner agrees to sign waiver forms authorizing the release of personal and background information.  In the event of noncompliance, to be determined at the sole discretion of Sponsor, the potential prize winner will be disqualified, and the prize will be awarded to an alternate winner.

 

Taxes. All federal, state and other tax liabilities (including income taxes and withholding taxes) arising from each prize awarded in this Sweepstakes will be the sole responsibility of each corresponding prize winner. The award of each prize with an ARV exceeding Six Hundred United States Dollars (US$600) will be reported to the Internal Revenue Service (“IRS”), as required by U.S. law using an IRS form 1099 and/or such other form(s) as are required by federal law. If applicable, Sponsor shall also report any winnings as required by applicable state law(s) using such form(s) as are required by applicable state law. Each winner subject to any such reporting requirements agrees that the ARV assigned to each prize herein and to be reported to the taxing authority is reasonable, and agrees not to dispute the amount of the ARV assigned to such prize.  In the event Sponsor is required by law to withhold U.S. federal or state withholding tax from any prize awarded (and pay such amount directly to the IRS or a state taxing authority), then Sponsor shall withhold any such amount and make such payment to the IRS and/or taxing authority to the extent sufficient cash is awarded as part of such prize. In that instance, if there is not sufficient cash available as part of the awarded prize to pay the entire withholding taxes required, then the prize winner shall be required to provide Sponsor with the funds sufficient to pay the required withholding taxes before the prize winner may receive the prize. If the prize winner in that instance fails to provide Sponsor with funds sufficient to pay the required withholding taxes within the deadline established by Sponsor, then the prize winner may be disqualified, and an alternate potential prize winner will be selected via a random drawing.

 

7. PUBLICITY AND COPYRIGHT LICENSE:

 

            By entering, entrant grants Sponsor an exclusive, worldwide, perpetual, irrevocable, unrestricted, royalty-free, sub-licensable and transferrable right and license to exploit the entrant’s entry (including, without limitation, the entrant’s name, image, likeness, voice, submitted biography, and prize information, as well as the names, images, likenesses and voices of any and all persons in the entry, and any intellectual property rights (e.g. copyright, trademark, etc.) contained in the entry), without prior notice, review, or approval, in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to entrant or any third party, for any purpose, including, without limitation, the entry and any person’s property (physical, personal, intellectual property rights, and indicia) contained therein. The foregoing grant includes, without limitation, the right to reproduce, display, distribute, publicly perform, create derivative works of, alter, amend, broadcast, edit, publish, use, merchandise, license, sublicense, and adapt the entry in any and all media now or hereafter known, throughout the world, for any purpose, whether commercial in nature or otherwise, including in contexts and circumstances that result in the entry being associated with Sponsor, its affiliated companies, and/or their promotional partners. Accordingly, by entering, entrant waives any objection to such use, including without limitation, distribution, reproduction, creation of derivative works of, public performance, or display of the entry, and any claim for compensation whatsoever in connection therewith. Such waiver shall include any claim for infringement of any so-called “Moral Right,” “Droit Moral” or similar right or interest. All materials submitted become the property of Sponsor and will not be returned. 

 

8. RELEASE:

 

            By entering, each entrant agrees that Sponsor, the Sweepstakes Administrator and each of their parent, subsidiary and affiliated companies, and their advertising and Sweepstakes agencies and promotional partners, and their wholesale distributors, and Tentrr, Inc., and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”), will have no liability whatsoever for, and are released and shall be held harmless by entrant against, any liability, for any injuries, losses or damages of any kind, to persons, including death, or property, or rights of publicity or privacy, defamation, copyright infringement or portrayal in a false light resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Sweepstakes or in any Sweepstakes-related activity.

 

9. GENERAL CONDITIONS:

 

Sponsor and Sweepstakes Administrator are not responsible for lost, late, misdirected, unintelligible, returned or undelivered entries, telephone calls, text messages, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network.  Persons who tamper with or abuse any aspect of this Sweepstakes or a related website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate any website’s terms of service, as solely determined by the Sponsor, will be disqualified.  Sponsor and Sweepstakes Administrator are not  responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Sweepstakes, and assume no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access.  Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries, and may subject that entrant to disqualification.  Sponsor and Sweepstakes Administrator are not responsible for injury or damage to participant's or any other person’s computer or property related to or resulting from participating in this Sweepstakes.  Should any portion of Sweepstakes be, in the Sponsor’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair administration, security, fairness or proper play of this Sweepstakes, or submission of entries, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes, and randomly select the winner from valid entries received prior to the action taken, or otherwise as may be deemed fair and equitable by the Sponsor. In the event of a dispute regarding the identity of an entrant, the authorized subscriber of the email address or the social media account used at the time of entry will be deemed to be the entrant and must comply with these rules.  The authorized account subscriber is the natural person who is assigned the email address or the social media account by the ISP or other organization responsible for assigning the email address or social media account.  A potential winner may be required to show proof of being the authorized account subscriber.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU, AND THE FOREGOING PARAGRAPHS SHALL NOT APPLY TO A RESIDENT OF NEW JERSEY TO THE EXTENT DAMAGES TO SUCH NEW JERSEY RESIDENT ARE THE RESULT OF ANY NEGLIGENT, FRAUDULENT OR RECKLESS ACT(S) OR INTENTIONAL MISCONDUCT ON THE PART OF SPONSOR OR SWEEPSTAKES ADMINISTRATOR. 

 

10. DISPUTE RESOLUTION:

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, or any claim or dispute that has arisen or may arise between entrant and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules.

            See Sponsor’s privacy policy located at www.michelobultra.com/privacy-policy  for details of Sponsor’s policy regarding the use of personal information collected in connection with this Sweepstakes.  If you are verified as a prize winner, your first name, last initial, city and state may be included in a publicly available winner’s list.

13. WINNERS’ LIST:

 

For a list of the winners, hand-print “ Michelob ULTRA Pure Gold Tentrr Pass Sweepstakes Winners' List Request”, your first and last name, and your complete address on a 3” x 5” card and mail to: Michelob ULTRA Pure Gold Tentrr Pass Sweepstakes  Winners’ List Request, Round, 420 Longview Drive, Lexington, KY 40503 for receipt within sixty (60) days after the end of the Sweepstakes Period.
