Participant Responsibilities & Waiver

Participant Responsibilities

I understand that the Fallen Timbers “Run for the Timbers” is a potentially hazardous event, and attend it out of my own free will and choice. It is my responsibility to dress appropriately for the event. I understand that thefts of equipment or personal belongings may occur if I do not safeguard my personal items.

Although route maps, rest stops, refreshments and other assistance may be available during this event, I am solely responsible for my participation in this event, and I agree to stop and request assistance if I experience any symptoms such as, but not limited to, dizziness, excessive fatigue, shortness of breath, pain, or any other condition which would make it difficult or unsafe for me to continue.

I hereby waive my rights of privacy or publicity and grant permission to all of the foregoing to use any photographs, motion pictures, videotapes, recordings or other record of this event for any legitimate purpose.

Waiver of Negligence

Run Disclaimer:  I know that the Fallen Timbers “Fun Run for the Timbers” is a potentially hazardous event.  The “Run for the Timbers” includes activities which include risks such as (but not limited to), falls, collisions with other participants, effects of weather, equipment failure, inadequate safety equipment, poor signage and/or planning of the route, and dangerous traffic and road conditions.

I agree, for myself and my heirs, to waive any claims arising out of the negligent acts of the organizers of this event.  I hereby release, indemnify and hold harmless Fallen Timbers Environmental Center, its affiliates, directors, volunteers, and employees, all sponsoring  businesses and organizations and their agents and employees and the Consortium of Schools for Environmental Education from any and all negligence arising out of my participation in the Run for the Timbers event.

The purpose of this release and waiver is to give up my right to sue Fallen Timbers Environmental Center and all event organizers for negligent acts.

This release and indemnification agreement shall be as broad and inclusive as is permitted by the State in which the event is conducted.  If any portion of it is held invalid, the balance shall continue in full force and effect.

I understand that the sole purpose for signing this document is to waive my right to sue Fallen Timbers Environmental Center for negligent acts.  I have read the terms of this agreement.  I understand that I am waiving my legal rights.  I agree to waive my legal rights.

If any participant is a minor, signature of the parent or guardian is required:  

I am the legal guardian of the listed participant, and hereby consent to his/her participation.  I’ve read the foregoing  release and indemnification agreement, and hereby agree on behalf of myself and the participant to its terms.
