I authorize Kidsville Playgym to charge my account tomorrow, and each month (on the same day each month), in the amount specified below. The authorization is extended by me to Kidsville Playgym and/or its authorized agents or firms engaged in the business of processing bank and charge card debits.  

I understand that this authorization agreement shall remain in force until I give Kidsville Playgym 30 days written notice of my intent to end my membership. Regardless of what payment method is utilized, I understand and authorize one more payment submitted/drafted within the 30-day cancellation period. I further understand that during the 30-day notice period, I will have access to the facilities and services of Kidsville Playgym, and that I am responsible for the monthly dues during that period. 

1. MEMBER’S and KIDSVILLE PLAYGYM'S RIGHT OF CANCELLATION.  This agreement can be canceled within seven business days after signature without impact. Notice of intent to end membership and membership card must be delivered in person to club or by certified mail addressed to 2375 Marron Road, Carlsbad, CA 92008 Attn: Membership. Kidsville Playgym reserves the right to cancel this membership agreement at its discretion.

2. AUTOMATIC RECURRING PAYMENTS.  Membership payment shall be initially that amount indicated on this document until changed by mutual conxent by either party. All fees are non-refundable. Delinquent accounts - In the event of a default on the commitment obligation, Kidsville Playgym has the right to collect all monies due in an accelerated manner plus any fees charged by a collection agency, and/or any reasonable attorney fees including court costs. Late or returned item charges - A $5.00 late fee will be assessed to any member failing to make payments by the due date, and the $25.00 for a returned credit card draft as a result of insufficient funds, closed account, or similar circumstance.

3. CHANGING AUTOMATIC RECURRING PAYMENT.  If you would like to change your Automatic Recurring Payment including, for example, making a change from one credit or debit card that was initially selected to another credit or debit card or bank account, you must authorize the recurring payment with the new credit or debit card or bank account by contacting Kidsville Playgym. Your new information will be implemented before the next billing cycle for your membership.

4. PARTICIPATION.  Failure to attend classes or events held does not constitute grounds for a refund or cancellation.

5. HOURS OF OPERATION - MEMBERSHIP VALID ONLY DURING OPEN PLAY HOURS.  This Memberhsip is only valid for entry during the Open Play hours posted by Kidsville Playgym. Operation schedules may vary and are subject to change from time to time. Kidsville Playgym may be closed on any day or any time of the week for private events, and for a period covering some holidays. This information will be posted on Kidsville Playgym's website.

6. UNAVAILABILITY OF FACILITY OR SERVICES.  A particular facility or service in the premises may be unavailable at any particular time due to mechanical breakdown, fire, act of God, condemnation, loss of lease, catastrophe or any other reason.

7. AMENDING THE RULES.  I understand that Kidsville Playgym reserves the right to amend or add to these conditions and to adopt new conditions as it may deem necessary for the proper management of the club and the business.

8. BINDING AGREEMENT.  I understand that this enrollment is binding in its terms and conditions, whether my use of the facility and its services is determined and paid for on a monthly or any other basis. This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and may be changed or added to only by a written amendment signed by both parties.
