The parties agree as follows:

Subject Matter. Bill White Enterprises may elect in its sole discretion to accept or reject order of Cards. If Bill White Enterprises accepts order of Cards, and upon receipt of payment, Bill White Enterprises shall provide individual with an agreed supply of active Cards. Title and risk of loss or damage to the Cards shall be borne by individual upon receipt of the Card from Bill White Enterprises. Bill White Enterprises shall not be responsible for Cards that are lost, stolen or damaged once in the possession of individual. Gift cards, once purchased, cannot be returned for credit nor exchanged. Purchase price (all or partial) is not refundable.

Card Acceptance. Bill White Enterprises shall accept properly activated Cards only at its Bill White Enterprises restaurant locations.

Use of Cards. Bill White Enterprises hereby grants individual the right to use Cards purchased under this agreement for personal use. Individual shall not have the right to resell Cards. Card is useable up to balance to purchase goods at all Bill White Enterprises restaurant locations. Not valid for gratuities. Not refundable or redeemable in cash except as required by law and may not be resold without permission. Not a debit or credit card. Will not be replaced or replenished if lost, stolen or used without authorization. Not subject to inactivity fees.

ACCEPTANCE *
